General Terms and Conditions of Short Term Rentals

Reservations

When a customer makes the reservation, it is understood that the customer accepts the following terms as outlined below. For any other questions or comments that you may have, please do not hesitate to contact us. We will be only too glad to help. On your arrival you will be given a document with your personal data and the terms of your reservation to be signed, and you will receive a copy of it at that time.

Payment

The Tenant prepays 25% of the let to reserve the apartment. The tenant pays the 75% rent balance and the Security Deposit in cash upon signature of the agreement and possession of the apartment or by bank transfer to the designated account one week before arrival. We advice having the agreed sum ready, avoiding the use of to cash machines because sometimes it is not possible to find them near the flats. Please we ask you kindly to help us to make the check-in easier and faster. Checks, or other similar documents are not accepted. Payment can only be made in cash with euros, no other currency will be accepted.

Deposit

The Security deposit is 100€ to 500€ depending upon the number of people and length of stay. On your departure, the apartment will be checked in order to ensure that it has not been damaged in any way and the deposit will then be returned. If it is not possible, for any reason, to check the apartment at the time of your departure, the breakage deposit will be returned via bank transfer within the following two days. However, if the apartment has suffered any damage, the cost arising from repairs will be deducted from the breakage deposit. Any damage in excess of the Security Deposit will be the responsibility of the tenant.

Hours of Arrival and Departure of the apartment

The arrival-departure time is flexible: you can check in-out between 9:00 h and 21:00 h. However between 21:00 h and 9:00 h, a 25€ surcharge will be applied. Please note, if another visitor is arriving or leaving the flat the same day of your departure/arrival , Check-in will be after 16:00 and check-out must be before 12:00 h. During the booking process we ask you for your estimated arrival time in Valencia so we can prepare for your arrival. Please inform us as soon as possible of any changes to your arrival plans; (if you did not provide your arrival information at the time of booking, please provide us with it before your arrival date). If you are arriving by airplane, once you have landed, you should call the contact person on the number provided in your booking confirmation email to confirm that you have arrived in Valencia and to arrange your check-in at the apartment. If you are arriving by road, rail or sea, you should make the call approximately one hour before arrival in Valencia.

Cancellation of reservation

In the event you need to cancel the reservation

  • All cancellations or changes must be made in writing via e-mail or fax. No cancellations or changes are accepted by phone.
  • If the customer cancels a booking they only lose the prepaid booking deposit.
  • If the customer cancels a reservation paid in full (100% of stay), there is a cancellation charge that will depend on the number of days in advance of the start of the rental period.
  • More than 90 days before: 25% of the total.
  • 30-89 days before: 50% of the total.
  • Less than 30 days before: 100% of the total.
  • If the client changes the dates of their stay or apartment, it will be construed as a new booking and subject to the cancellation policy.
  • It is recommended to purchase travel cancellation insurance. Any cancellation, even including due to force majeure, shall be subject to our clear and simple cancellation policy stated herein.

On behalf of the owner

Should we be forced to cancel the reservation due to events beyond our control, we will endeavour to communicate this to the customer as quickly as possible. We will also try to offer another apartment with the same characteristics or better. Should this not be possible, we will offer the customer a lesser apartment with the corresponding reduction in price. Should the customer not be satisfied with the alternative, we will immediately give the customer a full refund of the reservation fee.

Number and Identity of Guests

  • The client will inform Perfect Spain the number of guests included in the reserve.
  • Unless otherwise agreed to with Perfect Spain otherwise, only the number of persons indicated by the client when booking shall be authorized to use the apartment.
  • The number of persons who may use the apartment may not exceed the number of persons allocated for each apartment, except children under two years.
  • At the time of any infringement of the aforementioned obligations, Perfect Spain at its sole discretion shall have the right to ask the client to leave the apartment, and the customer will not be entitled to any compensation.

Cleaning

The apartment will be handed over in perfectly clean and tidy condition. We kindly ask you to treat the apartment with the greatest possible care. Cleaning service is available at cost, 10 euros a hour.

Pets

It is in general the policy of the owner not to allow the admission of pets except in special circumstances which will be considered by the owner.

Complaints

Should there be any problem during your stay, please contact us so that we can immediately proceed to rectify it. Please be aware that complaints will be not be considered at the time of your departure. If the problem is the owner’s responsibility, we will endeavor to compensate or relocate the customer in a similar or better apartment to that currently occupied by the customer without additional cost. Should the problem be not the direct responsibility of the owner, we will endeavor to resolve the problem although in this case the customer will not be compensated. You can be assured in the unlikely event of a problem; the owner will put the maximum effort into resolving it as soon as possible with the minimum inconvenience to the customers.

Owner is not responsible for loss, damage or inconvenience due to malfunctioning appliances, utilities, internet access etc. or for damage to or loss of property of any kind which may be lost, stolen, damaged or destroyed by fire, water, defective refrigeration or otherwise while on or about the leased premises. In the unlikely event of a problem; the Owner will put the maximum effort into resolving it as soon as possible with the minimum inconvenience to the customers.

All personal property kept by Tenant shall be at Tenant’s sole risk.
To the maximum degree allowed by law, Owner is not liable for injury to the Tenant or anyone in the unit or on the premises with Tenant’s acquiescence, knowledge or permission, nor does Owner’s insurance cover same or their belongings. Tenant agrees and acknowledges that protection against criminal action is not within the power of the Owner., and even if security services are provided, those services cannot be relied upon by Tenant and shall not constitute a basis for liability in any manner for criminal or wrongful actions by others against Tenant or invitees. Tenant agrees and acknowledges that Owner shall have no duty to provide any security services to Tenant. Tenant shall look solely to the public police force for security protection. In the event of any claim, judgment, decree, etc. against Owner, Tenant agrees that Tenant shall look solely to Owner’s interest in the leased premises and in no event shall any other property, real or personal, be subject to levy, execution, enforcement etc. Tenant acknowledges that Owner suggests that the Tenant obtain insurance to cover loss or damage to personal property, personal injury, and liability insurance.

The following is forbidden during occupancy

  • Introduce furnishings into the apartment or perform repairs or alterations.
  • Exceed the maximum capacity of occupants as stated for the apartment.
  • Sub-let the apartment or use it for purposes other than those for which it was contracted.
  • Introduce flammable or explosive materials into the building or any other materials which could cause damage or disturbance to neighbors.
  • Indulge in any activity which causes a hygiene or a public nuisance or disturbs other users of the building. Noise is forbidden after 22.00h inside the apartment and also in the stairwell.
  • Introduce animals into the building when it has been expressly forbidden to do so by the owner.
  • Any breach of the above rules may result in the owner taking whatever necessary corrective action. Guests not respecting these points will be immediately asked to leave the property with no refund of the rental payment and deposit. We thank you for your understanding.

Additional rules:

  • If upon the end of the rental period, the apartment does not comply with the minimum cleaning requirements, 50 € will be deducted from the Security Deposit. The minimum cleaning requirements are considered to be: not to leave any of rubbish in the bin or in the flat, to leave the fridge empty and any washing up to be done in the sink. To leave blankets, bedspreads or duvets and used sheets and towels in the cloth baskets or folded on the beds and leave things and furniture in a tidy condition.
  • All the keys provided must be returned at check-out. It’s absolutely forbidden to copy the keys. If the customer loses, breaks or damages them, 35€ must be paid for each set.
  • No smoking is allowed in the apartments or common areas of the building.
  • Normal use of utilites are included in the let. Normal usage is deemed as 300kwh of electricity per month. Any usage over 300kwh per month will be charged at the prevailing rate. For shorter stays the electricity usage will be prorated from the monthly usage.

Responsibilities

  • Neither Perfect Spain nor the owner of the apartment shall be liable for any direct or indirect that may arise as a result of the use by the client of the apartment, including without limitation, damages, insurance, losses because of fires, robbery or criminal behavior .
  • In case of any violation of the aforementioned obligations, Perfect Spain at its sole discretion shall have the right to ask the client to leave the apartment, and the customer is not entitled to claim any compensation.

Terms and Conditions of Use

Data Protection

In compliance with the obligations deriving from the statutory law 15/1999, of the 13th December of the Protection of Personal Data, we inform you that your personal data, as well as all data necessary, to facilitate the delivery of the contracted service, will be included in a file, properly notified to the Spanish Agency for Protection of Data (AEPD), and for which Perfect Spain is responsible. The purpose of said collection of data is to formalize and manage our services satisfactorily. In accordance with the aforementioned law, you are able to exercise the right of access, cancellation, rectification and opposition, communicating to Perfect Spain. C/ Conde de Olcoau 3-4 46003 Valencia, providing accreditation of your identity by means of a photocopy of your passport or identity card together with the application for exercising of said right.

Acceptance of the terms and conditions

Perfect Spain reserves the right to update any of its terms and conditions at any time, as may be required to and as may be in line with the company's business. The onus is placed on all parties, using the site, to undertake adequate measures to ensure that they visit any such terms and conditions on a regular basis. By agreeing to use this site, it is implied that any such changes are accepted by any such third party and, that any such third party undertakes to comply with any such changes. Perfect Spain reserves the right to modify rates and prices, photographs and descriptions presented on its website at any time; Perfect Spain is not responsible for and nor does it guarantee the capacity or suitability of any service or product advertised on its website.
